Delegate Fluharty moves to amend HB4700 on page 1, following the enacting clause, by striking out the remainder of the bill and inserting in lieu thereof, the following:

 

"ARTICLE 22D. WEST VIRGINIA LOTTERY SPORTS WAGERING ACT.

 

§29-22D-15a. Person prohibited from participating in sport wagering

(a) Legislative findings- It is the finding of the Legislature that gaming and sports betting is a privilege and that the state of West Virginia has an expectation of gaming and sport bettors not to threaten or harass sporting event participants.  Therefore, persons who have been found to undertake such actions are not suited to participate in any form of legalized gaming and sports betting in this state.

(b) Definitions-

For the purposes of this section:

(1) "Participants" means athletes, officials, coaches, and others affiliated with any school or organization participating in a sporting event.

(c) Banning of gaming authorization-   Any person authorized to participate in gaming and betting activities under the provisions of this chapter who threatens or harasses a participant of a sporting event may be prohibited from all forms of gaming and betting authorized under this Chapter by the Commission.  If the Commission finds that a person's conduct meets the requirements of this section, the Commission may prohibit that person from participating in all types gaming and betting for a period of time as determined by the Lottery Commission by adding the person to its exclusionary list as provided for by legislative rule promulgated by the Commission."
